Na dotaz na\u0161\u00ed \u010dten\u00e1\u0159ky t\u00fdkaj\u00edc\u00ed se problematiky v\u011bcn\u00e9ho b\u0159emena, odpov\u00edd\u00e1 Mgr. Hedvika Hartmanov\u00e1.<\/p>\n\n\n\n

Jsem vlastn\u00edkem n\u011bkolika pozemk\u016f, kter\u00e9 v souhrnu tvo\u0159\u00ed jednu plochu. Ov\u0161em \u2013 uprost\u0159ed plochy m\u00fdch pozemk\u016f je pozemek jin\u00e9ho vlastn\u00edka a na n\u011bm stoj\u00ed budova. K t\u00ed\u017ei m\u00fdch pozemk\u016f (s v\u00fdjimkou jednoho) je z\u0159\u00edzeno v\u011bcn\u00e9 b\u0159emeno ch\u016fze a j\u00edzdy ve prosp\u011bch pozemku tohoto jin\u00e9ho vlastn\u00edka. Mohu postavit plot s vjezdy na hranici, tj. okolo, v\u0161ech sv\u00fdch pozemk\u016f?<\/strong><\/p>\n\n\n\n

V\u011bcn\u00e9 b\u0159emeno omezuje vlastn\u00edka nemovitosti ve prosp\u011bch jin\u00e9ho vlastn\u00edka tak, \u017ee vlastn\u00edk je povinen strp\u011bt v\u00fdkon ur\u010dit\u00e9ho pr\u00e1va t\u0159et\u00ed osoby. V p\u0159\u00edpad\u011b uveden\u00e9m v dotazu se jedn\u00e1 o povinnost strp\u011bt ch\u016fzi \u010di j\u00edzdu po vlastn\u00edch pozemc\u00edch opr\u00e1vn\u011bnou osobou. V\u011bcn\u00e9 b\u0159emeno ch\u016fze i j\u00edzdy (dle nov\u00e9ho ob\u010dansk\u00e9ho z\u00e1kon\u00edku \u201eslu\u017eebnost\u201c) m\u016f\u017ee b\u00fdt v\u00e1z\u00e1no na konkr\u00e9tn\u00ed osobu, nebo na jak\u00e9hokoli vlastn\u00edka nemovitosti, v jej\u00ed\u017e prosp\u011bch je v\u011bcn\u00e9 b\u0159emeno z\u0159\u00edzeno. Je-li v\u00e1z\u00e1no na osobu, pak pouze tato osoba m\u016f\u017ee v\u011bcn\u00e9 b\u0159emeno vykon\u00e1vat, a po jej\u00ed smrti toto pr\u00e1vo zanik\u00e1. Je-li v\u00e1z\u00e1no v\u011bcn\u00e9 b\u0159emeno na nemovitost, pak p\u0159ech\u00e1z\u00ed v\u017edy na nov\u00e9 majitele.<\/p>\n\n\n\n

P\u0159edpokl\u00e1d\u00e1m, \u017ee ve Va\u0161em p\u0159\u00edpad\u011b je pr\u00e1vo v\u011bcn\u00e9ho b\u0159emene ch\u016fze a j\u00edzdy zavkladov\u00e1no v p\u0159\u00edslu\u0161n\u00e9m katastru nemovitost\u00ed. Pozemky ve Va\u0161em vlastnictv\u00ed v takov\u00e9m p\u0159\u00edpad\u011b m\u016f\u017eete oplotit za podm\u00ednky, \u017ee vlastn\u00edku pozemku, v jeho\u017e prosp\u011bch je z\u0159\u00edzeno v\u011bcn\u00e9 b\u0159emeno ch\u016fze a j\u00edzdy, bude i nad\u00e1le umo\u017en\u011bn neru\u0161en\u00fd v\u00fdkon pr\u00e1va vypl\u00fdvaj\u00edc\u00edho z uveden\u00e9ho v\u011bcn\u00e9ho b\u0159emene. Budou-li v r\u00e1mci oplocen\u00ed z\u0159\u00edzena uzamykateln\u00e1 vrata nebo dv\u00ed\u0159ka, pak tato bu\u010f mus\u00ed z\u016fstat nezam\u010den\u00e1, anebo je nutn\u00e9 p\u0159edat vlastn\u00edkovi opr\u00e1vn\u011bn\u00e9mu z v\u011bcn\u00e9ho b\u0159emene kl\u00ed\u010de od z\u00e1mku. Byl-li by tomuto vlastn\u00edkovi znemo\u017en\u011bn v\u00fdkon pr\u00e1va ch\u016fze a j\u00edzdy p\u0159es v\u011bcn\u00fdm b\u0159emenem zat\u00ed\u017een\u00e9 pozemky, pak tento vlastn\u00edk je opr\u00e1vn\u011bn po Va\u0161\u00ed osob\u011b jako osob\u011b povinn\u00e9 z v\u011bcn\u00e9ho b\u0159emena po\u017eadovat n\u00e1hradu \u0161kody zp\u016fsobenou poru\u0161en\u00edm Va\u0161ich povinnost\u00ed dan\u00fdch smlouvou o v\u011bcn\u00e9m b\u0159emenu. \u0160koda by byla soudn\u011b vymahateln\u00e1 a musela by b\u00fdt samoz\u0159ejm\u011b \u0159\u00e1dn\u011b prok\u00e1z\u00e1na. Rovn\u011b\u017e by p\u0159\u00edpadn\u011b bylo mo\u017en\u00e9 podat \u017ealobu na zdr\u017een\u00ed se Va\u0161eho jedn\u00e1n\u00ed (v\u00fdstavba oplocen\u00ed), kter\u00e9 by vlastn\u00edku opr\u00e1vn\u011bn\u00e9mu z v\u011bcn\u00e9ho b\u0159emene znemo\u017e\u0148ovalo v\u00fdkon pr\u00e1va ch\u016fze a j\u00edzdy.<\/p>\n\n\n\n

V\u00fd\u0161e uveden\u00e9 neplat\u00ed pro pozemek, kter\u00fd v\u011bcn\u00fd b\u0159emenem nen\u00ed zat\u00ed\u017een. Tento si m\u016f\u017eete libovoln\u011b oplotit a znemo\u017enit na n\u011bho p\u0159\u00edstup jak\u00e9koli t\u0159et\u00ed osob\u011b. Pokud by v\u0161ak tento v\u011bcn\u00fdm b\u0159emenem nezat\u00ed\u017een\u00fd pozemek byl v\u00fdznamn\u00fd pro v\u00fdkon v\u011bcn\u00e9ho b\u0159emene ch\u016fze a j\u00edzdy, pak osoba opr\u00e1vn\u011bn\u00e1 m\u016f\u017ee podat u p\u0159\u00edslu\u0161n\u00e9ho soudu n\u00e1vrh na z\u0159\u00edzen\u00ed pr\u00e1va ch\u016fze a j\u00edzdy i p\u0159es tento pozemek. Soud zv\u00e1\u017e\u00ed rozsah pot\u0159eb vlastn\u00edka nemovitosti bez p\u0159\u00edstupu a nutnost v\u00e9st p\u0159\u00edstupovou cestu p\u0159es dan\u00fd pozemek. Pokud by do\u0161lo ke ztr\u00e1t\u011b p\u0159\u00edstupov\u00e9 cesty v d\u016fsledku absence v\u011bcn\u00e9ho b\u0159emene p\u0159es jeden pozemek, m\u016f\u017ee b\u00fdt p\u0159\u00edstupov\u00e1 cesta z\u0159\u00edzena na z\u00e1klad\u011b rozhodnut\u00ed soudu i p\u0159es tento, dosud v\u011bcn\u00fdm b\u0159emenem nezat\u00ed\u017een\u00fd pozemek.<\/p>\n\n\n\n

V souvislosti s pr\u00e1vem ch\u016fze a j\u00edzdy je rovn\u011b\u017e nutn\u00e9 p\u0159ipomenout, \u017ee v\u011bcn\u00e9 b\u0159emeno se z\u0159izuje bu\u010f za jednor\u00e1zovou \u00faplatu, nebo za pravideln\u011b se opakuj\u00edc\u00ed odm\u011bnu. D\u00e1le je d\u016fle\u017eit\u00e9, \u017ee vlastn\u00edkovi povinn\u00fdch pozemk\u016f je osoba opr\u00e1vn\u011bn\u00e1 z v\u011bcn\u00e9ho b\u0159emene povinna p\u0159isp\u00edvat na \u00fadr\u017ebu cesty.
