Dobr\u00fd den, asi p\u0159ed rokem jsem koupila prost\u0159ednictv\u00edm renomovan\u00e9 realitn\u00ed kancel\u00e1\u0159e rodinn\u00fd domek i s pozemkem. Vlastnick\u00e9 pr\u00e1vo k rodinn\u00e9mu domku bylo \u0159\u00e1dn\u011b zaps\u00e1no do katastru nemovitost\u00ed s t\u00edm, \u017ee po celou dobu vkladov\u00e9ho \u0159\u00edzen\u00ed nic nenasv\u011bd\u010dovalo tomu, \u017ee by mohl nastat v budoucnu n\u011bjak\u00fd probl\u00e9m. P\u0159ed asi 14 dny jsem obdr\u017eela dopis od insolven\u010dn\u00edho spr\u00e1vce o tom, \u017ee p\u0159edchoz\u00ed majitel rodinn\u00e9ho domku vstoupil do insolvence a \u017ee tento spr\u00e1vce zahrnuje m\u016fj rodinn\u00fd domek do majetkov\u00e9 podstaty dlu\u017en\u00edka-p\u0159edchoz\u00edho vlastn\u00edka domku, nebo\u0165 se domn\u00edv\u00e1, \u017ee kupn\u00ed smlouva na domek je neplatn\u00fdm pr\u00e1vn\u00ed \u00fakonem. Aby toho nebylo m\u00e1lo obdr\u017eela jsem tak\u00e9 od Policie \u010cR usnesen\u00ed o zaji\u0161t\u011bn\u00ed rodinn\u00e9ho domku. Jako d\u016fvod pro zaji\u0161t\u011bn\u00ed bylo uvedeno, \u017ee rodinn\u00fd domek je v\u00fdnosem trestn\u00e9 \u010dinnosti. Porad\u00edte mi pros\u00edm, jak vzniklou situaci vy\u0159e\u0161it, tak abych nep\u0159i\u0161la o rodinn\u00fd domek a o \u017eivotn\u00ed \u00faspory?<\/em><\/p>\n\n\n\n

Va\u0161e ot\u00e1zka se dot\u00fdk\u00e1 dvou zcela odli\u0161n\u00fdch pr\u00e1vn\u00edch situac\u00ed, kter\u00e9 ov\u0161em nevylu\u010duj\u00ed to, aby nemohly nastat z\u00e1rove\u0148. V p\u0159\u00edpad\u011b, \u017ee byla va\u0161e nemovitost insolven\u010dn\u00edm spr\u00e1vcem zahrnuta do majetkov\u00e9 podstaty dlu\u017en\u00edka, je t\u0159eba ve lh\u016ft\u011b 30 dn\u016f od vyrozum\u011bn\u00ed insolven\u010dn\u00edho spr\u00e1vce podat proti n\u011bmu u m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00e9ho insolven\u010dn\u00edho soudu \u017ealobu na vylou\u010den\u00ed nemovitosti z majetkov\u00e9 podstaty. <\/p>\n\n\n\n

Vylu\u010dovac\u00ed \u017ealoba by mohla b\u00fdt podpo\u0159ena argumenty t\u00fdkaj\u00edc\u00ed se toho, \u017ee jste p\u0159i n\u00e1kupu rodinn\u00e9ho domku jednala v dobr\u00e9 v\u00ed\u0159e, \u017e\u00e1dn\u00e1 skute\u010dnost nenasv\u011bd\u010dovala tomu, \u017ee by kupn\u00ed smlouva mohla b\u00fdt neplatn\u00fdm \u00fakonem, a to i s p\u0159ihl\u00e9dnut\u00edm k tomu, \u017ee ve\u0161ker\u00e9 podpisy na smlouv\u011b byly \u00fa\u0159edn\u011b ov\u011b\u0159eny a nemovitost jste kupovala prost\u0159ednictv\u00edm renomovan\u00e9 realitn\u00ed kancel\u00e1\u0159e s podporou advok\u00e1ta. D\u00e1le by bylo mo\u017en\u00e9 uv\u00e9st, \u017ee jste kupn\u00ed cenu \u0159\u00e1dn\u011b, v\u010das a dle podm\u00ednek, a\u0165 u\u017e kupn\u00ed nebo smlouvy o \u00faschov\u011b zaplatila. Rovn\u011b\u017e je t\u0159eba m\u00edt na pam\u011bti, \u017ee r\u00e1mci vkladov\u00e9ho \u0159\u00edzen\u00ed dlu\u017en\u00edk nevznesl jak\u00e9koli n\u00e1mitky ohledn\u011b neplatnosti kupn\u00ed smlouvy nebo uveden\u00ed v omyl v r\u00e1mci uzav\u0159en\u00ed kupn\u00ed smlouvy a nezpochybnil ani n\u00e1vrh na proveden\u00ed vkladu vlastnick\u00e9ho pr\u00e1va k rodinn\u00e9mu domku. Pokud byste podpo\u0159ila tato tvrzen\u00ed i n\u00e1le\u017eit\u00fdmi d\u016fkazy s t\u00edm, \u017ee by insolven\u010dn\u00ed spr\u00e1vce dostate\u010dn\u00fdm zp\u016fsobem neprok\u00e1zal, \u017ee jste p\u0159edchoz\u00edho vlastn\u00edka-dlu\u017en\u00edka uvedla v omyl, m\u011bl by soud rozhodnout o vylou\u010den\u00ed nemovitosti z majetkov\u00e9 podstaty dlu\u017en\u00edka, tud\u00ed\u017e by rodinn\u00fd domek z\u016fstal ve va\u0161em vlastnictv\u00ed. <\/p>\n\n\n\n

V p\u0159\u00edpad\u011b by se p\u0159edchoz\u00ed vlastn\u00edk rodinn\u00e9ho domku dom\u00e1hal neplatnosti kupn\u00ed smlouvy, p\u0159i\u010dem\u017e dan\u00e1 v\u011bc by nebyla p\u0159edm\u011btem insolven\u010dn\u00edho \u0159\u00edzen\u00ed, jako je ve Va\u0161em p\u0159\u00edpad\u011b, pak by byl nucen podat \u017ealobu na ur\u010den\u00ed, zda tu pr\u00e1vn\u00ed vztah je, \u010di nen\u00ed. Zjednodu\u0161en\u011b by to znamenalo podat \u017ealobu na ur\u010den\u00ed, zda mezi V\u00e1mi a p\u0159edchoz\u00edm vlastn\u00edkem rodinn\u00e9ho domku byl kupn\u00ed smlouvou zalo\u017een pr\u00e1vn\u00ed vztah, \u010di nikoliv. Va\u0161e argumentace v tomto \u0159\u00edzen\u00ed by byla v z\u00e1sad\u011b shodn\u00e1 s tou, kterou jsme uvedli v odstavci v\u00fd\u0161e. P\u0159edchoz\u00ed vlastn\u00edk rodinn\u00e9ho domku by d\u00e1le musel u p\u0159\u00edslu\u0161n\u00e9ho katastru nemovitost\u00ed podat \u017e\u00e1dost na vyzna\u010den\u00ed pozn\u00e1mky spornosti, jej\u00edm\u017e \u00fa\u010delem by bylo upozornit na to, \u017ee jsou v katastru nemovitosti ve vztahu k va\u0161emu rodinn\u00e9mu domu uvedeny n\u011bjak\u00e9 nesrovnalosti. \u017d\u00e1dal-li by p\u0159edchoz\u00ed vlastn\u00edk rodinn\u00e9ho domku o vyzna\u010den\u00ed pozn\u00e1mky spornosti na p\u0159\u00edslu\u0161n\u00e9m katastru nemovitost\u00ed, musel by u\u017e v okam\u017eik pod\u00e1n\u00ed t\u00e9to \u017e\u00e1dosti dolo\u017eit, \u017ee o uzn\u00e1n\u00ed sv\u00e9ho vlastnick\u00e9ho pr\u00e1va usiluje takt\u00e9\u017e \u017ealobou.<\/p>\n\n\n\n

Druh\u00e1 \u010d\u00e1st va\u0161\u00ed ot\u00e1zky se t\u00fdk\u00e1 situace, kdy byl V\u00e1\u0161 rodinn\u00fd domek zaji\u0161t\u011bn polici\u00ed. Dan\u00fd stav zna\u010d\u00ed situaci, kdy v souvislosti s uzav\u0159en\u00edm kupn\u00ed smlouvy s p\u0159edchoz\u00edm vlastn\u00edkem mohlo doj\u00edt ke sp\u00e1ch\u00e1n\u00ed n\u011bjak\u00e9ho trestn\u00e9ho \u010dinu. Proti usnesen\u00ed policie o zaji\u0161t\u011bn\u00ed rodinn\u00e9ho domku je mo\u017en\u00e9 podat opravn\u00fd prost\u0159edek, a to st\u00ed\u017enost. Je t\u0159eba myslet na to, \u017ee lh\u016fta pro pod\u00e1n\u00ed st\u00ed\u017enosti \u010din\u00ed pouh\u00e9 3 dny. St\u00ed\u017enost by bylo mo\u017en\u00e9 od\u016fvodnit op\u011bt t\u00edm, \u017ee jste kupovala nemovitost v dobr\u00e9 v\u00ed\u0159e. <\/p>\n\n\n\n

Z kontextu Va\u0161eho cel\u00e9ho dotazu vypl\u00fdv\u00e1, \u017ee v dan\u00e9m p\u0159\u00edpad\u011b byl rodinn\u00fd domek sp\u00ed\u0161e ke sp\u00e1ch\u00e1n\u00ed trestn\u00e9ho \u010dinu pou\u017eit, ale \u017ee rozhodn\u011b nen\u00ed v\u00fdnosem z trestn\u00e9 \u010dinnosti. T\u00edmto v\u00fdnosem bude p\u0159edev\u0161\u00edm kupn\u00ed cena, kter\u00e1 byla n\u011bkomu bez Va\u0161eho p\u0159i\u010din\u011bn\u00ed a v\u011bdom\u00ed neopr\u00e1vn\u011bn\u011b vyplacena. <\/p>\n\n\n\n

I v p\u0159\u00edpad\u011b, \u017ee bude rodinn\u00fd domek ze strany policie zaji\u0161t\u011bn, nem\u011bla byste se ob\u00e1vat, \u017ee byste v t\u00e9to souvislosti o rodinn\u00fd domek p\u0159i\u0161la i s p\u0159ihl\u00e9dnut\u00edm k tomu, \u017ee jste v dan\u00e9 v\u011bci po\u0161kozen\u00e1. <\/p>\n\n\n\n

Zaji\u0161t\u011bn\u00ed rodinn\u00e9ho domku je pouze p\u0159edb\u011b\u017en\u00e9 opat\u0159en\u00ed, kter\u00e9 slou\u017e\u00ed k tomu, aby nedoch\u00e1zelo k vyveden\u00ed majetku mimo dosah org\u00e1n\u016f \u010dinn\u00fdch v trestn\u00edm \u0159\u00edzen\u00ed. Samotn\u00e9 rozhodnut\u00ed o zaji\u0161t\u011bn\u00ed V\u00e1s tud\u00ed\u017e nezbavuje v \u017e\u00e1dn\u00e9m p\u0159\u00edpad\u011b majetkov\u00fdch pr\u00e1v k rodinn\u00e9mu domku.<\/p>\n\n\n\n
