Obdob\u00ed po smrti bl\u00edzk\u00e9ho \u010dlov\u011bka je pro ka\u017ed\u00e9ho dot\u010den\u00e9ho velmi emo\u010dn\u011b a psychicky n\u00e1ro\u010dn\u00e9 a \u010dasto spojen\u00e9 se zvyk\u00e1n\u00edm si na novou realitu bez p\u0159\u00edtomnosti zem\u0159el\u00e9ho. Nicm\u00e9n\u011b je t\u0159eba m\u00edt na pam\u011bti, \u017ee toto obdob\u00ed je pro poz\u016fstal\u00e9 takt\u00e9\u017e spojeno s celou \u0159adou povinnost\u00ed, kter\u00e9 \u00fazce souvis\u00ed s \u0159e\u0161en\u00edm a spravov\u00e1n\u00edm administrativn\u00edch a \u00fa\u0159edn\u00edch z\u00e1le\u017eitost\u00ed po zem\u0159el\u00e9m. Mezi tyto z\u00e1le\u017eitosti pat\u0159\u00ed mimo jin\u00e9 povinnost poz\u016fstal\u00fdch vy\u0159e\u0161it ukon\u010den\u00ed smlouvy o sdru\u017een\u00fdch dod\u00e1vk\u00e1ch energi\u00ed \u2013 plynu a elekt\u0159iny do nemovitosti zem\u0159el\u00e9ho. Tento \u010dl\u00e1nek poskytne \u010dten\u00e1\u0159\u016fm z\u00e1kladn\u00ed n\u00e1stin a n\u00e1vod, jak postupovat v situaci, kdy bl\u00edzk\u00fd p\u0159\u00edbuzn\u00fd zem\u0159e a z\u00e1rove\u0148 bude mezi jeho osobou a dodavatelem elekt\u0159iny\/plynu uzav\u0159ena smlouva o sdru\u017een\u00fdch dod\u00e1vk\u00e1ch energi\u00ed.<\/p>\n\n\n\n

Hned v \u00favodu tohoto \u010dl\u00e1nku pova\u017eujeme za d\u016fle\u017eit\u00e9 \u010dten\u00e1\u0159e upozornit na skute\u010dnost, \u017ee \u00famrt\u00ed p\u0159\u00edbuzn\u00e9ho nem\u00e1 za n\u00e1sledek ukon\u010den\u00ed smlouvy o sdru\u017een\u00fdch dod\u00e1vk\u00e1ch energi\u00ed \u2013 plynu a elekt\u0159iny (d\u00e1le tak\u00e9 \u201esmlouva\u201c) bez dal\u0161\u00edho, pon\u011bvad\u017e ob\u010dansk\u00fd z\u00e1kon\u00edk stanov\u00ed z\u00e1sadu, \u017ee smrt\u00ed dlu\u017en\u00edka jeho povinnost nezanikne, leda\u017ee jej\u00edm obsahem bylo pln\u011bn\u00ed, kter\u00e9 m\u011blo b\u00fdt osobn\u011b pln\u011bno dlu\u017en\u00edkem. Za tento p\u0159\u00edpad osobn\u00edho pln\u011bn\u00ed nen\u00ed rozhodn\u011b mo\u017en\u00e9 pova\u017eovat pen\u011b\u017en\u00ed pln\u011bn\u00ed dodavateli elekt\u0159iny\/plynu jako protislu\u017ebu za dod\u00e1vku energi\u00ed. <\/p>\n\n\n\n

S ohledem na tuto skute\u010dnost maj\u00ed p\u0159\u00edbuzn\u00ed zem\u0159el\u00e9ho povinnost s t\u00edm, \u017ee toto je takt\u00e9\u017e jejich z\u00e1jmu, p\u0159edm\u011btnou smlouvu s p\u0159\u00edslu\u0161n\u00fdm dodavatelem energi\u00ed ukon\u010dit. Ukon\u010den\u00ed smlouvy se v z\u00e1sad\u011b prov\u00e1d\u00ed dv\u011bma zp\u016fsoby, a to bu\u010f p\u0159episem odb\u011brn\u00e9ho m\u00edsta z osoby zem\u0159el\u00e9 na p\u0159\u00edbuzn\u00e9ho tak, aby z\u016fstala dod\u00e1vka energi\u00ed do odb\u011brn\u00e9ho m\u00edsta – nemovitosti zachov\u00e1na. Pokud z nejr\u016fzn\u011bj\u0161\u00edch d\u016fvod\u016f nen\u00ed ji\u017e nutn\u00e1 dod\u00e1vka energi\u00ed do odb\u011brn\u00e9ho m\u00edsta a nikdo ji pot\u0159ebovat nebude, je mo\u017en\u00e9 smlouvu s dodavatelem zcela ukon\u010dit.<\/p>\n\n\n\n

V obou p\u0159\u00edpadech bude nutn\u00e9 u dodavatele energi\u00ed vyplnit p\u0159\u00edslu\u0161n\u00fd formul\u00e1\u0159 podle toho, zda si budete p\u0159\u00e1t smlouvu ukon\u010dit, \u010di p\u0159epsat na jinou osobu. Dodavatel\u00e9 energi\u00ed nicm\u00e9n\u011b vy\u017eaduj\u00ed k umo\u017en\u011bn\u00ed p\u0159episu smlouvy na jinou osobu nebo \u00fapln\u00e9ho ukon\u010den\u00ed smlouvy dolo\u017eit n\u011bjak\u00fd doklad, ze kter\u00e9ho by bylo z\u0159ejm\u00e9, \u017ee poz\u016fstal\u00ed zem\u0159el v\u010detn\u011b \u010destn\u00e9ho prohl\u00e1\u0161en\u00ed n\u011bkter\u00e9ho z p\u0159\u00edbuzn\u00fdch. Nej\u010dast\u011bji bude jako pat\u0159i\u010dn\u00fd doklad slou\u017eit kopie \u00famrtn\u00edho listu, ale ve v\u00fdjime\u010dn\u00fdch p\u0159\u00edpadech bude dodavatel energi\u00ed zcela jist\u011b akceptovat nap\u0159\u00edklad i soudn\u00ed rozhodnut\u00ed o prohl\u00e1\u0161en\u00ed za mrtv\u00e9ho. D\u00e1le je t\u0159eba m\u00edt na pam\u011bti, \u017ee s p\u0159episem smlouvy nebo jej\u00edm ukon\u010den\u00ed nen\u00ed nutn\u00e9 \u010dekat do zah\u00e1jen\u00ed nebo dokonce a\u017e do skon\u010den\u00ed d\u011bdick\u00e9ho \u0159\u00edzen\u00ed, kter\u00e9 m\u016f\u017ee v n\u011bkter\u00fdch p\u0159\u00edpadech trvat m\u011bs\u00edce. Pro \u00faplnost uv\u00e1d\u00edme, \u017ee p\u0159\u00edpadn\u00e9 nedoplatky, \u010di p\u0159eplatky bude \u0159e\u0161it dodavatel s p\u0159\u00edpadn\u00fdmi d\u011bdici.<\/p>\n\n\n\n

V p\u0159\u00edpad\u011b, \u017ee by ze strany poz\u016fstal\u00fdch nedo\u0161lo k ukon\u010den\u00ed smlouvy nebo p\u0159episu na novou osobu, je nutn\u00e9 po\u010d\u00edtat s riziky a probl\u00e9my, kter\u00e9 by toto opomenut\u00ed mohlo zp\u016fsobit. Za situace, kdy by poz\u016fstal\u00ed opomn\u011bli u\u010dinit v\u00fd\u0161e uveden\u00e9 kroky a i nad\u00e1le odeb\u00edrali energie na z\u00e1klad\u011b smlouvy, kter\u00e1 je uzav\u0159ena na ji\u017e ne\u017eij\u00edc\u00ed osobou, automaticky by to neznamenalo neopr\u00e1vn\u011bn\u00fd odb\u011br ve smyslu energetick\u00e9ho z\u00e1kona, tedy odb\u011br bez platn\u011b uzav\u0159en\u00e9 smlouvy. Nicm\u00e9n\u011b pro \u00fa\u010dely na\u0161eho \u010dl\u00e1nku vych\u00e1zejme ze skute\u010dnosti, \u017ee by faktury za odb\u011br energi\u00ed, \u010di p\u0159\u00edpadn\u00e9 upom\u00ednky za nedoplatky z\u00e1loh i nad\u00e1le chodili na jm\u00e9no a adresu zem\u0159el\u00e9ho, proto\u017ee dodavatel energi\u00ed by nem\u011bl \u017e\u00e1dn\u00e9 tu\u0161en\u00ed o jeho \u00famrt\u00ed. Kdyby k podobn\u00e9 situaci do\u0161lo, znamenalo by to d\u0159\u00edve, \u010di pozd\u011bji n\u00e1siln\u00e9 odpojen\u00ed odb\u011brn\u00e9ho m\u00edsta od distribu\u010dn\u00ed soustavy z d\u016fvodu pro neplacen\u00ed, p\u0159i\u010dem\u017e op\u011btovn\u00e9 zapojen\u00ed odb\u011brn\u00e9ho m\u00edsta do distribu\u010dn\u00ed soustavy je v z\u00e1sad\u011b u v\u0161ech dodavatel\u016f energi\u00ed spojeno s poplatkem, jeho\u017e v\u00fd\u0161e se u jednotliv\u00fdch dodavatel\u016f li\u0161\u00ed. I v tomto p\u0159\u00edpad\u011b by poz\u016fstal\u00ed po zem\u0159el\u00e9m byli povinni uhradit dluh za odb\u011br energi\u00ed viz dal\u0161\u00ed text.  <\/p>\n\n\n\n

Pokud by p\u0159\u00edbuzn\u00ed naopak zam\u00fd\u0161leli \u00famrt\u00ed sv\u00e9ho bl\u00edzk\u00e9ho vyu\u017e\u00edt ve sv\u016fj prosp\u011bch t\u00edm, \u017ee by odeb\u00edrali energie i nad\u00e1le na z\u00e1klad\u011b smlouvy po zem\u0159el\u00e9m a za takto odebran\u00e9 energie by nic neplatili, pon\u011bvad\u017e by se domn\u00edvali, \u017ee by dodavatel vym\u00e1hal dluh pouze po zem\u0159el\u00e9m a oni by za takto odebran\u00e9 energie nebyli \u017e\u00e1dn\u00fdm zp\u016fsobem odpov\u011bdni. Je tyto nutn\u00e9 zklamat a z\u00e1rove\u0148 upozornit na skute\u010dnost, \u017ee i za takto zp\u016fsoben\u00fd dluh by poz\u016fstal\u00ed odpov\u00eddali. Jakmile by dodavatel energi\u00ed zjistil, \u017ee p\u0159\u00edbuzn\u00fd zem\u0159el, zah\u00e1jil by ve\u0161ker\u00e9 kroky k tomu, aby zjistil, jak\u00fdm zp\u016fsobem bylo po zem\u0159el\u00e9m p\u0159\u00edbuzn\u00e9m d\u011bdick\u00e9 \u0159\u00edzen\u00ed vy\u0159\u00edzeno a kdo se stal po n\u011bm d\u011bdicem. Jakmile by toto dodavatel energi\u00ed zjistil, za\u010dal by dluh vznikl\u00fd na odb\u011brn\u00e9m m\u00edst\u011b vym\u00e1hat opr\u00e1vn\u011bn\u011b po d\u011bdic\u00edch zem\u0159el\u00e9ho. Pro \u00faplnost uv\u00e1d\u00edme, \u017ee tito p\u0159\u00edbuzn\u00ed\/d\u011bdicov\u00e9 by odpov\u00eddali za dluh za odb\u011br energi\u00ed do smrti zem\u0159el\u00e9ho z titulu p\u0159echodu dluh\u016f po zem\u0159el\u00e9m a za obdob\u00ed po smrti zem\u0159el\u00e9ho z titulu p\u0159echodu pr\u00e1v a povinnost\u00ed ze smlouvy o sdru\u017een\u00fdch dod\u00e1vk\u00e1ch energi\u00ed na d\u011bdice. Jednodu\u0161e \u0159e\u010deno to znamen\u00e1, \u017ee na m\u00edsto zem\u0159el\u00e9ho ve smlouv\u011b by nastoupili d\u011bdici po n\u011bm, kte\u0159\u00ed by ho ve smlouv\u011b nahradili.<\/p>\n\n\n\n

Shrneme-li v\u00fd\u0161e uveden\u00e9, doporu\u010dujeme \u010dten\u00e1\u0159\u016fm po smrti p\u0159\u00edbuzn\u00e9ho u\u010dinit bezodkladn\u011b ve\u0161ker\u00e9 kroky, kter\u00e9 by sm\u011b\u0159ovaly k ukon\u010den\u00ed smluv o sdru\u017een\u00fdch dod\u00e1vk\u00e1ch energi\u00ed, jednak aby se p\u0159ede\u0161lo z d\u016fvodu neplacen\u00ed za energie k odpojen\u00ed odb\u011brn\u00e9ho m\u00edsta od distribu\u010dn\u00ed soustavy a n\u00e1sledn\u00e9mu zbyte\u010dn\u00e9mu hrazen\u00ed poplatku za op\u011btovn\u00e9 p\u0159ipojen\u00ed, tak i z d\u016fvodu toho, aby d\u011bdicov\u00e9 nebyli po n\u011bjak\u00e9 dob\u011b vyzv\u00e1ni k hrazen\u00ed dluhu za odb\u011br energi\u00ed v nemovitosti, a\u010dkoli tuto v\u016fbec nevyu\u017e\u00edvali nebo ji vyu\u017e\u00edvali dokonce zcela jin\u00e9 t\u0159et\u00ed osoby.        <\/p>\n","protected":false},"excerpt":{"rendered":"
