Dne 01.10.2023 nabude \u00fa\u010dinnosti dlouho o\u010dek\u00e1van\u00e1 novela z\u00e1kon\u00edku pr\u00e1ce. Jak\u00e9 zm\u011bny n\u00e1s v\u0161ak konkr\u00e9tn\u011b \u010dekaj\u00ed?<\/p>\n\n\n\n

1) Dohody o proveden\u00ed pr\u00e1ce a pracovn\u00ed \u010dinnosti<\/strong>
Novela z\u00e1kon\u00edku p\u0159ich\u00e1z\u00ed s pom\u011brn\u011b rozs\u00e1hlou \u00fapravou pracovn\u00edch pom\u011br\u016f na DPP \u010di DP\u010c. Zm\u011bny se
t\u00fdkaj\u00ed hned n\u011bkolik oblast\u00ed, rozebran\u00fdch n\u00ed\u017ee.<\/p>\n\n\n\n

Dohoda<\/strong>
Dohoda jako takov\u00e1 mus\u00ed b\u00fdt v\u017edy p\u00edsemn\u00e1.<\/strong> V dohod\u011b o proveden\u00ed pr\u00e1ce mus\u00ed b\u00fdt uvedeny sjednan\u00e9
pr\u00e1ce a doba, na kterou se tato dohoda uzav\u00edr\u00e1. Dohoda o pracovn\u00ed \u010dinnosti mus\u00ed nav\u00edc obsahovat sjednan\u00fd i rozsah pracovn\u00ed doby.<\/p>\n\n\n\n


Poskytov\u00e1n\u00ed odm\u011bny z\u00a0dohody<\/strong>
Nov\u011b budou m\u00edt i zam\u011bstnanci na DPP \u010di DP\u010c n\u00e1rok na poskytnut\u00ed odm\u011bny z\u00a0dohody.<\/strong> Jedn\u00e1 se o odm\u011bnu poskytovanou nap\u0159\u00edklad za pr\u00e1ci ve zt\u00ed\u017een\u00e9m pracovn\u00edm prost\u0159ed\u00ed, n\u00e1hradn\u00ed volno nebo n\u00e1hrada mzdy za sv\u00e1tek, mzda za pr\u00e1ci o v\u00edkendu apod. Odm\u011bna z\u00a0dohody bude pro pracovn\u00edky na DPP a DP\u010c posuzov\u00e1na jako mzda.<\/p>\n\n\n\n


Zam\u011bstnanc\u016fm t\u00e9\u017e bude n\u00e1le\u017eet pr\u00e1vo na \u010derp\u00e1n\u00ed v\u0161ech p\u0159ek\u00e1\u017eek v\u00a0pr\u00e1ci<\/strong> a t\u00e9\u017e n\u00e1rok na dovolenou.<\/strong><\/p>\n\n\n\n


Zam\u011bstnanec naopak nem\u00e1 n\u00e1rok na n\u00e1hradu odm\u011bny<\/strong> z dohody po dobu trv\u00e1n\u00ed jin\u00fdch d\u016fle\u017eit\u00fdch osobn\u00edch p\u0159ek\u00e1\u017eek v pr\u00e1ci a p\u0159ek\u00e1\u017eek v pr\u00e1ci z d\u016fvodu obecn\u00e9ho z\u00e1jmu. N\u00e1rok v\u0161ak lze stanovit dohodou \u010di vnit\u0159n\u00edm p\u0159edpisem.<\/p>\n\n\n\n

Rozvrh pracovn\u00ed doby<\/strong>
Zam\u011bstnavatel\u00e9 budou m\u00edt nov\u011b i u pracuj\u00edc\u00edch na dohodu povinnost p\u0159edem vypracovat p\u00edsemn\u00fd rozvrh pracovn\u00ed doby, se kter\u00fdm budou muset zam\u011bstnance sezn\u00e1mit. Nen\u00ed-li stanoveno jinak, plat\u00ed, \u017ee zam\u011bstnanec mus\u00ed b\u00fdt s rozvrhem obezn\u00e1men nejpozd\u011bji 3 dny p\u0159ed za\u010d\u00e1tkem sm\u011bny nebo obdob\u00ed, na n\u011b\u017e je pracovn\u00ed doba rozvr\u017eena.

T\u00e9\u017e zam\u011bstnavatel\u016fm p\u0159ibude povinnost evidovat odpracovanou dobu zam\u011bstnanc\u016f na dohodu stejn\u011b tak, jak \u010din\u00ed u zam\u011bstnanc\u016f na pracovn\u00ed pom\u011br.<\/p>\n\n\n\n


P\u0159echod na pracovn\u00ed pom\u011br<\/strong>
Pokud po\u017e\u00e1d\u00e1 zam\u011bstnanec pracuj\u00edc\u00ed na dohodu v souhrnu alespo\u0148 180 dn\u00ed b\u011bhem p\u0159edchoz\u00edch 12 m\u011bs\u00edc\u016f zam\u011bstnavatele o zam\u011bstn\u00e1n\u00ed v pracovn\u00edm pom\u011bru, m\u00e1 zam\u011bstnavatel povinnost zam\u011bstnanci nejd\u00e9le do 1 m\u011bs\u00edce p\u00edsemn\u011b odpov\u011bd\u011bt.<\/strong>

Zru\u0161en\u00ed dohody<\/strong>
Dohodu lze zru\u0161it pouze p\u00edsemn\u011b, a to t\u0159emi zp\u016fsoby:<\/p>\n\n\n\n
